These Terms govern your access to, usage of all content, Product and Services available at https://thesocialum.com website (the “Service”) operated by Socialum Digital Media (“us”, “we”, or “our”).

Your access to our services is subject to your acceptance, without modification, of all of the terms and conditions contained herein and all other operating rules and policies published and that may be published from time to time by us.

Please read the Agreement carefully before accessing or using our Services. By accessing or using any part of our Services, you agree to be bound by these Terms. If you do not agree to any part of the terms of the Agreement, then you may not access or use our Services.

Agreement Disclaimer

Socialum Digital Media shall have the authority to modify the SLA (Service Level Agreement Terms & Policies) subject to changes in the law. Any changes to the decided policy shall be posted to the user or visitor and you agree to adhere to it. The modifications shall be posted for the convenience of the user/visitor by all possible known means, visible pages, and by any possible communication.

This agreement of services is limited to the services we provide on our web portal. We might use third-party services which we do not have exclusive control over. For the third-party services, the end-user shall read their terms of services, privacy policies, and/or available SLAs.

Socialum Digital Media reserve the right to disclose your personally identifiable information as required by law and when they believe that disclosure is necessary to protect their rights and/or to comply with a judicial proceeding, court order, or legal process served on our Website, blog, other social accounts which are active and verified and owned by Socialum Digital Media only.

As soon as subscriber and Socialum Digital Media starts the conversation by any means like Phone Call, Online Platform Audio/Video call, reference call, personal meeting call, face to face meeting or any possible conversation call is considered as ‘First Contact Clause’ hereinafter. 

As soon as the first contact clause takes place, the subscriber agrees to follow the SLA and terms of Socialum Digital Media.


A. General Terms
  1. Socialum Digital Media reserves the right, in its sole discretion, to suspend or cancel any of the services at any time if a subscriber is in denial of the said agreement, denied and/or fails to pay on time as per the pre-defined payment plans, abuses the services and/or consulting, adding third-party services for advertising and/or promoting, without providing any notice to us.
  2. Socialum Digital Media disclaims all warranties or conditions, whether expressed or implied, (including without limitation implied, warranties or conditions of information and context).
  3. Socialum Digital Media will use reasonable efforts to supply a continuous service. However, Socialum Digital Media is not liable for any loss of data resulting from delays outside of its control, missed or non-deliveries, service interruptions, or errors or omissions of the customer or the third party services.
  4. Socialum Digital Media is not responsible for any losses suffered resulting from acts of God or force majeure including civil unrest, riots, floods, drought, pandemic, fire, war, and imposing legislation.
  5. Socialum Digital Media reserves the right to refuse service to anyone at any time to all of its subscriber(s) or to a limited number(s) of subscriber(s).
  6. Socialum Digital Media is not liable to the subscriber for any special consequential damages which the subscriber may suffer as a result of loss of business, contracts, profits, savings, or otherwise.
  7. Socialum Digital Media is unable to exercise control over material sent over the internet and excludes all liability of any kind for the publication by the Customer of inaccurate, misleading, offensive, threatening, or obscene material, or material that is in breach of Indian cyber law, International Cyberlaw, COPPA, and GDPR.
  8. The subscriber agrees to fully and effectively indemnify Socialum Digital Media against all losses, costs, actions, proceedings, claims, damages, online transaction security, misconduct of financial transfers (online/offline) expenses, (including legal expenses) or liabilities, howsoever suffered or incurred directly and/or indirectly by Socialum Digital Media in consequence of the subscriber’s breach or non-observance of this Clause.
  9. The subscriber shall defend and pay all costs, damages, awards, fees (including legal expenses), and judgments awarded against Socialum Digital Media arising from breach or breaches of this SLA & Terms.
  10. Socialum Digital Media may in its absolute discretion defend such claims and may compromise such claims with the consent of the subscriber, such consent not to be unreasonably withheld. The subscriber shall provide Socialum Digital Media with the assistance necessary to defend such claims, at the subscriber’s sole expense.
  11. Once the visitor becomes a subscriber, it is the subscriber’s duty to provide accurate information while registering on the portal. Socialum Digital Media may challenge any subscriber who is breaching the security of the portal in any means and/or breaching this agreement.
  12. The visitor(s) and/or subscriber(s) should not copy any kind of material which is available on the Socialum Digital Media web portal.
  13. The subscriber agrees and understands that Socialum Digital Media may not backup their data that they upload on the server. In case of any failure of the server, termination, and/or suspension of any subscriber’s account, Socialum Digital Media will not be responsible for that subscriber(s’) data.
  14. In case of any loss of data and/or damage of the data by any means, the subscriber will not hold Socialum Digital Media responsible for any loss, damage, and otherwise. The subscriber cannot claim any refund, damage fee, and/or otherwise.
  15. Socialum Digital Media will provide support to every subscriber who is registered with Online Verge Blog and/or Socialum Digital Media portal. With every possible support, Socialum Digital Media shall give you the guarantee of 99.99% of full support towards your products and/or services related to Socialum Digital Media.
  16. All the proposal documents which have been sent to the particular subscriber will have a validity of 30 business days. After completing the 30 business days, the proposal will not be considered a valid proposal. If we did not get any response for such a proposal within the next 30 business from the date of the proposal, that proposal will be considered as a canceled proposal and Socialum Digital Media will not provide any services mentioned on that proposal document.
  17. Once the proposal is canceled for any reason, Socialum Digital Media will have full authority to send another proposal or to deny the service forever.
  18. The support team is available from 10.00 AM (Indian Standard Time) to 07.00 PM (Indian Standard Time). Subscribers can expect full support in a given period of time. In case, if the subscriber raises the support ticket after 07.00 PM, the subscriber requested to wait for the answer from the support team.
  19. Subscriber agrees that the Socialum Digital Media support team will not be held responsible for any damage to the subscriber’s online/offline data and/or activities in any case and/or scenario.
  20. The subscriber should not abuse, offend, create personal threats, and/or else to the Socialum Digital Media support team and/or individual. In case of offensive behavior of any subscriber(s), the support shall stop reverting to that particular subscriber, and Socialum Digital Media shall suspend the subscriber’s account and/or terminate the subscriber’s account.
 
B. Online Establishments

Socialum Digital Media expects its subscriber(s) to have a basic infrastructure of the online establishment(s). This establishment(s) shall include the following services which are categorized as mandatory and/or necessary establishment(s).

i) Domain & Hosting Web-Services

  1. Any subscriber, who is expecting an online-based service from us, shall consider having a domain and/or business name domain.
  2. The domain name should be matching with its online business and/or service(s) and/or product(s).
  3. The domain should not be misleading and/or inappropriate which is considered unlawful by any government.
  4. Subscriber shall consider booking a web-hosting service along with its fully qualified domain name if expected to run any business online and/or display product(s) and/or service(s) online.  
  5. The web hosting services should be matching with the product(s) and/or service(s) capacity and region. And it should have minimum and/or maximum infrastructure and/or configuration to handle the online establishments.
  6. The domain name should be registered under the ICANN organization. We can challenge the domain owner to verify the domain name authority and/or information from its registrars at any given moment.

ii) Social Account Establishment(s)

  1. The subscriber shall have self-verified social accounts if he/she/it has planning to promote and/or run social media advertisement campaign(s).
  2. The subscriber shall have their ‘Username’ on each social network which they have control over. In the case of multiple social accounts on the same and/or multiple social media accounts, that particular customer should inform Socialum Digital Media about the usage, behavior, and/or intention of that said account(s).
  3. If a subscriber owns any social account and/or wishes us to handle, that account(s) then the subscriber shall grant us the access as required.
C. Communication Services

Communication services are mandatory for us, subscribers, and its clients. We all shall be communicating via available communication platforms. The communication services platform(s) account(s) shall be authorized, owned, and/or rented by the subscriber. The same account(s) shall be accessible for us if necessary.

i) Email

  1. In case we as a media service provider and subscriber decides to exchange the email(s) relating to the said and/or subscribed service(s), the conversation shall be kept undisclosed to any other third party until unless it is mandatory to share, also the conversation record’s access shall be provided to the third party with the written consent of Socialum Digital Media if we are involved in the conversation.
  2. The conversation which takes place on any provided email should not be disclosed publicly in any kind of format, if such actions are found on any available media, including print media, the subscriber who owns the email ID should be held responsible for such action and legal action will be taken by Socialum Digital Media.
  3. In case of any private and/or anonymous email services; i.e, Protonmail, Tor Mail, the user is requested to verify their true identity to Socialum Digital Media with written consent with government verified self-identity documents. 

ii) Auto-bots

  1. In case the subscriber has allowed us to manage their social media account and/or any other account, on behalf of the said subscriber, that subscriber should know that we might prefer to automate the conversation on provided platforms using auto-bots.
  2. Auto-bots will be set to answer some basic questions which will be activated once the user from the other side of the same and/or similar platform starts the conversation.

iii) Website/App

  1. We might use auto-bots services on the subscriber’s website and/or app to automate the conversation which might take place on the website and/or app if we are not available to attend the conversation.
  2. On the subscriber’s website, we will be installing preferred WordPress plugins and/or Google forms for communication purposes. It is the subscriber’s responsibility to check all the conversations as it receives.

iv) Content Creation, Publishing & Control

  1. When Socialum Digital Media is hired and authorized to post on behalf of the subscriber, the simple MOU (Memorandum of Understanding) shall be considered in case we are supposed to create the social media post and/or any kind of post which will be distributed publicly on the internet.
  2. The content will be created using online and/or offline software/app/website which helps us to create outstanding content and to save time.
  3. The content will be created according to the general business industry standards.
  4. Socialum Digital Media encourages its subscribers to get involved in the process of content creation.
  5. The content might include social media pictures, posts, art, illustration, video, blog post, any design, logo, website art, picture, background graphics, different graphical styles, gallery, etc.
  6. The content will be created considering the present image of the subscriber, we cannot create any kind of illusion, fake promises design art, content or design creation which includes violent and illegal graphics which might defend some social class, the design which represents any hidden agenda, the design which might mislead or confuse the society and/or viewer, the content which is not considered as legal by any government.
  7. Once the content is created for the subscriber, the subscriber will have a full but not exclusive right to re-distribute the content by any means.
  8. The subscriber cannot redistribute and/or resell the created content which is created by Socialum Digital Media, without any written consent.  
  9. The subscriber cannot claim the copyright over the content which is created by Socialum Digital Media which was created for the purpose to create a social post, online advertisement, and/or print media graphics and advertisement.
  10. The subscriber cannot publish the created content on different social media accounts which are not owned by the same subscriber.

v) Data Collection

  1. When any social media post has been sent, that post might get a response from the available users which are verified by that particular platform.
  2. We use third-party software to collect the data of the user(s) who are involved in our social media campaign which might be running for our subscribers.
  3. The said platforms in this agreement, such as website, app, social media accounts, and other available platforms will be generating data that might be useful for the subscriber.
  4. We, as Socialum Digital Media only act as a data observer. We do not own the data, which was generated via free and/or paid advertising on selected platforms.
  5. We might be processing the data using custom software that is designed in a particular fashion in the favor of our subscribers so the data can be processed and managed.
  6. In the case of any third-party platform, i.e. Amazon, we might be using their own platform to run the paid advertising campaign and might be transmitting the campaign data via available API and storing the data to process and manage for the subscriber.
  7. We do not have any intentions to keep the data forever for the subscriber and its customers. In case of deletion of the subscriber account, either from the purchased server or we as a firm decision to deny our services to the subscriber, the subscriber will be responsible for the data they collect, handle, manage, and/or otherwise.
  8. Once the subscriber is no longer our subscriber, we do not control any kind of software which is owned and managed by that subscriber.
  9. If a subscriber decides to stop the services from Socialum Digital Media, the subscriber solely will be responsible for any kind of action which might take place on several platforms, social media accounts, advertising platforms, and/or custom software.
D. Advertising

i) Free Advertising

  1. On our web portal, the prices page shall be accessible for the public and visitors of the portal. The prices page’s online status might change and will be only decided by Socialum Digital Media.
  2. We have full rights to take down our website and related pages at any given moment.
  3. In our free advertising, our subscribers cannot expect us to make a guaranteed sale of their service(s) and/or product(s).
  4. In case the subscriber’s service(s) and/or product(s) fails to deliver its said features and/or else, Socialum Digital Media will not be held responsible for that.
  5. In Free Advertising, the subscriber may expect free service(s) from Socialum Digital Media for 7 days before turning the project into paid services.
  6. Socialum Digital Media has full rights to charge the subscriber after the ‘Free’ period is over. In case of any denial, the firm has full rights to deny the services.
  7. Subscriber agrees that In case of Free services, whatever data and/or content is created by Socialum Digital Media for the subscriber for any platform(s); i.e, Website, Social media Content, etc, all rights of the data, content, project, business concept, idea, IPR will belong and will be owned by Socialum Digital Media only and Socialum Digital Media can re-sell, re-distribute any content, data, project, IPR of the subscriber to any third party without any consent or written notice to the subscriber (only if we are involved in the Free plan and first contact clause of this document).


ii) Paid Advertising

  1. In ‘Paid Advertising’, the subscriber needs to understand that, the paid advertising means, the firm will be charging subscribers as per the pricing plan which may be visible on the web portal of Socialum Digital Media or will be sent via preferred ways of communication/transfer.
  2. The charges which are mentioned on visible pages of the portal only represent the service charges of Socialum Digital Media. The said charges will be applied as per Socialum Digital Media executive work and pricing scope, the firm has full rights to choose any one of the options or to change the price.
  3. The social media advertising charges should be paid by the subscriber-only. Socialum Digital Media will not pay any kind of payment to the advertising platform.
  4. In case of Socialum Digital Media and subscribers agree on an offer where Socialum Digital Media will be paid advertising charges on behalf of the particular subscriber, the subscriber agrees to pay the advertising budget amount accordingly including Socialum Digital Media’s charges.
  5. Socialum Digital Media will be only handling and managing the advertising platforms on behalf of the subscriber.


iii) Enterprise Advertising

  1. This type of advertising is limited to only selected subscribers. To avail of this plan, the subscriber needs to complete the necessary actions which are set and designed by Socialum Digital Media.
  2. General category subscribers shall not have an opportunity to avail of the enterprise advertising services as we decide whom to serve the enterprise advertising services.

E. Advanced Advertising Management Tools
  1. In case of using any advanced advertising management tools and platforms, the subscriber needs to pay the amount of that management tool.
  2. The firm can only suggest the tool(s) which can be used for particular campaigns and/or management.
  3. In case of ad buying from 3rd party and/or media placement buying from any online established ad network, the firm is only responsible for getting in touch with those platforms or negotiating terms on behalf of the subscriber in case if needed. The firm is not responsible for any damage to the brand name or finance when the deal is done with ad networks. 
  4. In case any of our subscribers decide to go with one or more ad networking agencies, the firm is not responsible for their financial loss and/or SLA which takes place between subscriber and ad networking company.  

F. Third-Party App/Software Responsibility
  1. In case of any issue from a third-party management tool(s), the subscriber should be headed to that particular third-party service provider.
  2. In case of any loss of data and/or account caused by a third party app and/or software, the subscriber cannot hold Socialum Digital Media responsible.
G. Concept Development
  1. Socialum Digital Media will be helping its subscribers to develop a business idea and/or concept with its reasonable efforts.
  2. Every business and/or individual shall not accept or assume the projection report to be the exact face value of a particular concept.
  3. Projection value and/or mentioned numbers, amounts, data, and related data will be presented as a ‘Projection’, defined as a possible upcoming business opportunity. These opportunities are based on market trends, government rules and regulations towards that particular business, market share, business investment, and conceptual business module of that subscriber.
  4. The concept development business module, which the firm presents, is purely based on assumptions not the exact number of upcoming business.
  5. All the business concept theory, data, projections, IPR, and content rights belong to Socialum Digital Media only and subscribers must buy the rights to use it and make money from it.
  6. If Socialum Digital Media found that the subscriber who is/was availing concept development services and he/she/it is/are re-selling the concept to the third party without any permission from Socialum Digital Media, that individual and/or company is liable for the damage and must pay minimum INR.50,00,000 to Socialum Digital Media. In addition, if Socialum Digital Media decides to pursue the situation and take it to the court the individual and/or company must pay all the fees of the legal procedures and agrees that he/she/it will pay all the damages to the Socialum Digital Media. 
H. Legal Structure & Business Analysis
  1. The subscriber of the firm needs to understand that their legal structure is the sole responsibility of their owners, founders, directors, and related representatives which that particular subscriber’s company and/or firm and/or organization has appointed.
  2. Socialum Digital Media has nothing to and/or does not have any intention to add and/or deduct any kind of legal structure and/or any business module structure whether it is present or future which shall take place in their particular company and/or firm.
  3. In case, any subscriber is sued and/or ongoing under any kind of crime and/or legal case in any jurisdiction, that particular firm, company, and/organization will indemnify Socialum Digital Media from any claims and incidents including clause H of this document.
  4. If any subscriber intentionally or unintentionally hides and/or did not disclose such legal matter which is ongoing and/or upcoming from Socialum Digital Media, that subscriber’s membership will be denied and canceled immediately, without any prior notice or any written consent from Socialum Digital Media.
  5. If any subscriber(s), any company which is partnered legally with the subscriber, any relative of the subscriber and/or any business, company, organization, firm, and/or individual who is directly and/or indirectly relate with the subscriber(s), hides any kind of legal matter and/or have any intentional and/or unintentional propaganda to sue Socialum Digital Media without any kind of proof, that subscriber and related group and/or individual, the company, etc. will have to face legal actions which will be taken by Socialum Digital Media.
I. Security
  1. The subscriber(s) is responsible for their own security in case of any online monitory transitions which might take place when transferring the money to Socialum Digital Media and/or third-party platform(s) and/or app(s).
  2. The username(s) and/or Password(s) of any provided/suggested platform(s) and/or app(s) will be the responsibility of that particular subscriber(s).
  3. The subscriber(s) will indemnify Socialum Digital Media from any kind of security misconduct and will not hold Socialum Digital Media & its executives, employees responsible for any security issues which might take place by human error or else.
J. Account Management & Support
  1. Socialum Digital Media support is limited to its provided services which are limited and according to MOU and plan which subscriber chooses. Socialum Digital Media might be able to help end-user(s)/subscriber(s) in case they are using any third-party software which is mentioned on our web portal and/or known to us.
  2. The Socialum Digital Media support team is available from 10 AM (IST) to 7 PM (IST).
  3. Socialum Digital Media team might help end-user/subscriber to install third-party software which is legal to use. The end-user agrees that the Socialum Digital Media support team will not be responsible if the installed program is not working properly after its installation. The end-user/subscriber cannot hold Socialum Digital Media for any kind of damages which happened because of third-party software installation.
  4. In case of any third-party software installation, Socialum Digital Media will not pay any kind of software fees on behalf of and/or for end-user/subscriber. The subscriber should pay all the third-party software fees and taxes.
K. Free Consultation Calls/Contact

i) Free Consultation call or First Contact clause. 

  1. By getting in touch with us via using any possible communication ways, the customer agrees and understands our terms.
  2. As we have allowed users/subscribers/customers/YouTube viewers/subscribers/paid/free customers to call us on provided numbers to clear the confusion and privacy concerns, we have shared possible ways to get in touch with us which are: Contact Us Form, WhatsApp chat-bot/WhatsApp Groups, CRM App
  3. Using the above methods customers can get in touch with for related advice which can be either free or paid. The pricing structure of advice policy is decided and/or will be decided by Socialum Digital Media.
  4. In case of direct call by any means between us and the customer, we always try to provide our best possible advice which can be based on that particular situation, issues, problem customer(s) provided on that time, and concept of the business. There might be other factors that can be considered while providing any kind of advice(s) by any means and/or communication mode.
  5. The customer agrees and understands that the advice which is provided by us is based upon the facts and experience. To follow or not to follow the advice or even to implement or not to implement totally depends upon the customer.
  6. Once the advice is provided and if the customer decides to follow and/or implement and while in the action of following if a customer faces any kind of damages whether in business and/or in personal life, he/she/it will not hold Socialum Digital Media, it’s agents, customers, officers, employees, founders, directors and/or any related person who is related by any mean with Socialum Digital Media responsible for any kind of damages including finances, liabilities, losses of their business(es), costs, claims or any relative products and/or services they provide; (Also including and referring to clause I from this document of terms.)
  7. By getting in touch with us by any way of communication you are giving us exclusive rights to collecting your information in any possible way which might be audio, video, pictures, etc. as we can call it ‘content’.
  8. You agree that you are giving us a royalty-free and exclusive license to reproduce, edit, publish, re-modify, re-distribute and publish your content. This content can be used by us as our advertisement material, content material, and/or else material which can be categorized as ‘content’. You agree that you are allowing us to use the content for free of cost which you provided and/or together we generated, created, or else which will be re-modified, re-edited, re-distributed, published publicly, published on social/online platforms using different online-offline tools/software and can be used as advertising material and/or else.
  9. You agree that you will not claim any kind of compensation whether it’s financially and/or royalty and/or accrediting your name and/or your company’s name.
L. Consulting – Subscription-Based Model
  1. We have introduced Consulting on demand. In this type of consulting we tend to provide month-to-month subscriptions of our services. As soon as the subscriber chooses to go with our subscription model, he/she/it agrees to our terms and SLA.
  2. Once the subscriber(s) chooses the subscription plan, the subscriber agrees to our terms Consulting Subscription Services.
  3. Subscriber agrees that the month-to-month subscription is based on service choices and options and whenever any subscriber chooses any plan of our  Consulting Subscription, all and/or selected services will be served and accommodated accordingly.     
  4. Once a subscriber subscribes to our subscription-based plan, he/she/it agrees to pay all the necessary service charges which are presented on the respected web page and/or any document.
  5. If any subscriber fails to pay for the month-to-month services, Socialum Digital Media reserves the full right to deny the services at any given moment. (Clause A & First Contact Clause) 
  6. When any subscriber starts the subscription, he/she/it can expect service delivery from Socialum Digital Media which depends on the agreement (MOU), the proposed scope of work, subscription payment compliances, data provided by the subscriber, and clause B, C, D & E.
  7. As it is a subscription-based service, subscribers will be billed on a monthly basis. On a certain date, as agreed on MOU and/or Proposal document, the invoice will be raised accordingly.
  8. To avail and continue the services on a monthly basis, the subscriber must pay a minimum of 60% of the subscription amount decided in advance and/or within every first week of the month. If any subscriber fails to pay at least 60% of the subscription amount in the first week (7 days) of every month and/or as per decided dates the subscriber shall be charged 20% extra for that particular month.
  9. If a subscriber fails to pay any charges of the subscription services to Socialum Digital Media, we will have every right to discontinue and/or deny the services and/or terminate the subscriber’s services. 
  10. Subscriber can cancel the subscription when needed, but the subscriber must provide us a notice of canceling the subscription service 7 days before. 
  11. Any subscriber can also get into the long-term subscription contract with Socialum Digital Media, but the minimum requirement of the contract should be at least 6 months.
M. Online Courses & Digital Assets
  1. Socialum Digital Media offers different courses to its subscribers. Course delivery will be decided by Socialum Digital Media. 
  2. Courses can be delivered online whether in LIVE session using respective and available platforms or uploaded on 3rd party platform(s) where any subscriber can go and attend the course. 
  3. While attending any LIVE course the student and/or attendee should not be recording any kind of content of the course. 
  4. In case we found that student(s) and/or attendee(s) of the course has recorded a LIVE session and/or downloaded courses video illegally that user(s) individual will be facing legal actions and agrees to pay Socialum Digital Media a damage fee of INR.100,000/- per action/video/audio/slide/Socialum Digital Media produced content etc.
  5. The student(s) and/or attendee(s) should not record and re-sell, re-distribute, re-teach with the same content to any other user who might be or might not be connected with Socialum Digital Media. Such user(s)will be liable to pay a damage fee of INR. 10,00,000/- and could face legal actions.
  6. The course’s LIVE dates will be displayed on a particular page, if any student(s) paid for the LIVE course and could not attend the LIVE course, that student(s) will not be liable for any refund and/or damage fees and/or any other charges. Once a student(s) pays for any course listed on the Socialum Digital Media website, he/she/it agrees that it is a non-refundable amount.
  7. We tend to provide some digital assets using our platform, to download and/or acquire digital assets we might ask the user(s) to submit their Name, Email ID, Mobile Number, and/or more information which might be necessary, the user(s) must provide the accurate information. 
  8. We might provide 3rd party resources (online/offline platforms) which might be included in our Courses and/or in digital assets, the user(s) agrees that we do not own the 3rdparty platforms and have no control over their platform/company behavior. The user(s) agrees that he/she/it will not hold Socialum Digital Media responsible in case of 3rd party error(s), business conduct style, and/or else.
  9. All courses offered by Socialum Digital Media are non-refundable.
  10. All online LIVE activities including paid courses might be recorded by Socialum Digital Media and some part and/or entire LIVE course can be published online for advertising purposes. In case of any objection to personal information of any person who has participated in the LIVE session would like to remove their own part which may include Audio/Video/Image from published material, he/she/it can ask for removal. 
N. Digital Workshops/Camps
  1. Socialum Digital Media provides Workshops/digital camps as a part of the service. Once any subscriber enrolls in the Workshop/digital camp, he/she/it understands and accepts the terms & SLA.
  2. Workshop/Digital camp is designed for educational purposes. Any subscriber who enrolls in the Workshop/digital camp will be taught certain digital platforms and their usage only.
  3. Socialum Digital Media will not pay any kind of charges in case of digital advertising, 3rd party platform service purchases or any other services which enrolled subscribers might need to run the application or else to match with their expectations.
  4. In Workshop/digital camp the term ‘flexible hours’ means that the subscriber who has enrolled in the digital camp can get in touch with Socialum Digital Media between 10:00 AM to 9:00 PM, Monday to Friday for support of the Workshop/digital camp support. 
  5. Workshop/Digital camp subscribers understand that the platforms which are going to be taught are not in control of Socialum Digital Media nor are we responsible for their changes. We do not have any kind of control over 3rd party platforms.
  6. In case any subscriber is not acquiring the skills which we teach then we are not responsible for the mistakes and losses it might cause by that particular subscriber(s).   
  7. Workshop/Digital camp fees are non-refundable and subscribers cannot hold Socialum Digital Media responsible for any financial loss and accept our indemnity clause.
O. E-commerce Services
  1. Socialum Digital Media provides E-commerce services for those businesses who wish to sell their product online using their own website and/or 3rd party website, for example, Amazon.
  2. When a customer requires to build their own eCommerce website, Socialum Digital Media might use third-party software and platforms to create their e-commerce website where they can list and sell their products.
  3. When we create an eCommerce website for any business, we, Socialum Digital Media is not responsible for any product miss-listing, fraudulent product and/or business, financial frauds, selling fake products. Socialum Digital Media does not take any kind of responsibility about what type of product its customer sells on their own eCommerce website.
  4. In case of any payment failure or fraud on a customer’s website, Socialum Digital Media will not be responsible for such transactions.
  5. Customers will adhere to 3rd party website’s terms of services if Socialum Digital Media decides to integrate their service into the customer’s website.  
  6. In the case of product transportation, Socialum Digital Media would suggest the process of delivering the product using various shipping methods available in the market or provided by 3rd party platforms, in case of shipping failure from such facilitation, we are not responsible for any kind of loss.
  7. In the case of tax documents and GST filing, Socialum Digital Media does not take any kind of responsibility for gathering such documents for the customers. Customers are responsible for gathering GST documents from 3rd party platforms or generating them on their own.
  8. Customers understand and accept that the business information he/she/it is providing to Socialum Digital Media is true and legal.
  9. Customers agree that in order to handle 3rd party apps and/or platforms on behalf of their company, we need to have certain types of access in their admin account. Customers understand and agree that it will indemnify Socialum Digital Media from any kind of damage in case if the admin panel loses some data, hacked, misused, in loss of finance, or failure of renewals. 
  10. In order to sell on Amazon, sellers must have a GST certificate.
  11. Once signed up for an Amazon Seller account, the seller agrees that the products will be at their own warehouse and/or place. Dropshipping is not allowed.
  12. In case the seller is selling 3rd party brand’s products then the seller must obtain a brand letter from that particular brand(s).
  13. In the case of self-shipping and/or easy shipping services by Amazon, the seller is responsible for product packaging.
  14. In order to register a seller account on Amazon Seller Central, sellers must provide accurate information about the company and the product.
  15. Socialum Digital Media will not be responsible for any kind of product refund, shipping failure refund, and/or Amazon advertising refund. 
  16. Socialum Digital Media does not guarantee 100% sales of the product.
P. Indemnity

The Customer agrees that it shall defend, indemnify, save and hold Socialum Digital Media harmless from any and all demands, liabilities, losses, costs, and claims, including reasonable legal fees, asserted against Socialum Digital Media, its agents, its customers, officers and employees, that may arise or result from any acts or omissions of the Customer, its agents, employees or assigns in connection with their use of the Services.
